Terms.

This site is run by Elliot Thomas, a sole trader trading as Product with Elliot, based in the United Kingdom. Contact me at [email protected], and I will provide a postal address on request.

I am not VAT registered, so no VAT is added to any fee quoted on this site. If that changes I will say so before quoting you anything.

Everything here describes services I offer and how I think about product. It is general information. It is not professional advice for your specific situation, and you should not act on it as though it were.

Nothing on this site is an offer capable of acceptance. Prices shown are starting points for a conversation. What you actually pay is confirmed in writing before any work begins.

I try hard to keep it accurate and current, but I do not warrant that it is free of errors, or that it will always be available.

The words, illustrations and design here are mine unless credited otherwise. Read them, share them, link to them, and quote them with attribution and a link back. Republishing substantial parts as your own is not on.

Do not try to break, overload or gain unauthorised access to the site, and do not use it for anything unlawful.

This site links out to other places, including my own products and the booking tool. I am not responsible for anything on a site I do not run.

This section is a plain-English summary so you know the shape of it before we talk. It is not the contract. Every engagement runs under a separate written agreement signed before work starts, and that agreement is what binds us. Where the two differ, the agreement wins.

Fees and invoicing

Agreed in writing before anything starts. Payment terms are set out in your agreement.

What you own

Everything I produce for you as part of the engagement is yours once the invoices for it are paid. The general methods, templates and know-how I bring with me stay mine, and I keep using them elsewhere.

Confidentiality

Runs both ways. I will sign your NDA. I do not name clients or show their material publicly without asking first, which is why the case studies on this site are my own products rather than client work.

Other clients

I work with several at once, and that is part of what you are buying. I will not take on a direct competitor of yours during an engagement without telling you first.

Employment status

I am engaged as an independent contractor, not an employee. I work for multiple clients, use my own equipment, and am engaged for an outcome rather than for my time. Status for tax is assessed per engagement, and I am happy to work through the determination with your accountant before we start.

Ending it

Either of us can end the engagement on the notice set out in the agreement. Engagements are meant to be temporary and I would rather they ended well than dragged on.

Nothing here limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Those carve-outs apply whatever else this page says.

Beyond that, the site is provided as it is, and I am not liable for loss arising from relying on general information published here rather than taking advice on your own situation.

Liability for paid work is dealt with in the engagement agreement, not here.

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

I may update this page. The version that applies to your use of the site is the one published at the time, and the date at the top tells you when it last changed.
